For the first time, the Confederation would agree to automatically adopt foreign law, to have it interpreted by a jurisdiction that is not its own, and to make its domestic policy conditional on the decisions of a bloc to which it does not belong.<\/p>\n<p class=\"p3\">In this context, the positions taken by Denis Pittet, Chairman of the Fondation Gen\u00e8ve Place Financi\u00e8re, a former executive at Lombard Odier and a well-known figure in Geneva's high finance sector, are no coincidence: they are in line with the view of a section of the financial centre that believes - wrongly - that European regulatory integration will guarantee the stability of its activities. We must therefore dismantle, point by point, this vision, which is legally false, economically risky and politically dangerous.<\/p>\n<h2><b>1 \u201cThe Bilaterals III are a continuation of the strategic partnership initiated in 1999.\u201d<\/b><\/h2>\n<p class=\"p3\">This is not true, and Denis Pittet knows it.<\/p>\n<p class=\"p3\">The 1999 agreements were based on three intangible pillars:<\/p>\n<ul>\n<li>\n<p class=\"p1\">no dynamic recovery of the law,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">no European jurisdiction,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">no institutional integration.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">On the contrary, the Unilateral III Agreements introduce :<\/p>\n<ul>\n<li>\n<p class=\"p1\">the compulsory adoption of European law and its developments,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">arbitration dependent on the interpretation of the CJEU,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">an automatic update mechanism.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">As Hans-Rudolf Merz reminded us:<\/p>\n<p class=\"p4\"><b>\u00abThe European acquis is like a spiral: once you're in, there's no way out.\u00bb<\/b><\/p>\n<p class=\"p3\">Pittet presents a historical break as a reassuring continuity. This is misleading.<\/p>\n<h2><b>2. \u201cStrengthening ties with the EU is a geopolitical necessity.\u201d<\/b><\/h2>\n<p class=\"p3\">Pittet is confusing two realities:<\/p>\n<p class=\"p3\">\u2192 economic cooperation<\/p>\n<p class=\"p3\">\u2192 legal integration<\/p>\n<p class=\"p3\">Nobody disputes the importance of the EU as a trading partner.<\/p>\n<p class=\"p3\">But Switzerland's prosperity is not based on normative submission - it's based on our differentiation.<\/p>\n<p class=\"p3\">The truly strategic agreement remains :<\/p>\n<p class=\"p3\">\u2192 the 1972 Free Trade Agreement, approved by the people.<\/p>\n<p class=\"p3\">There's no need to go through thousands of pages of European law to do business.<\/p>\n<h2><b>3. \u201cThis is not EU membership.\u201d<\/b><\/h2>\n<p class=\"p3\">Technically true. Politically untrue.<\/p>\n<p class=\"p4\"><span class=\"s2\">The Unilateral III Agreements are a <\/span><b>functional membership without political rights<\/b><span class=\"s2\"> :<\/span><\/p>\n<ul>\n<li>\n<p class=\"p1\">we take up the standards,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">we are subject to case law,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">we apply the penalties,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">no seat, no vote, no veto.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">As Professor Daniel Th\u00fcrer points out:<\/p>\n<p class=\"p4\"><b>\u00abIntegration without representation is more dangerous than formal membership.\u00bb<\/b><\/p>\n<p class=\"p3\">That's exactly what we're doing.<\/p>\n<h2><b>4. \u201cThere is no automatic alignment.\u201d<\/b><\/h2>\n<p class=\"p3\">Not true.<\/p>\n<p class=\"p3\">The mechanism provides for :<\/p>\n<ul>\n<li>\n<p class=\"p1\">compulsory adaptations,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">retaliatory measures in the event of refusal,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">arbitration that must comply with the logic of the CJEU.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">In other words:<\/p>\n<p class=\"p3\">\u2192 alignment is automatic in practice.<\/p>\n<h2><b>5. \u201cThe arbitration tribunal will be composed of equal numbers of members.\u201d<\/b><\/h2>\n<p class=\"p3\">Only in appearance.<\/p>\n<p class=\"p3\">In any dispute involving European law, the arbitrator will have to rely on the interpretation...<\/p>\n<p class=\"p3\">\u2192 of the CJEU.<\/p>\n<p class=\"p3\">Conclusion:<\/p>\n<ul>\n<li>\n<p class=\"p1\">joint arbitration in form,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">unilateral subordination in substance.<\/p>\n<\/li>\n<\/ul>\n<h2><b>6. \u201cAgreements are essential for access to the European market\u201d.\u201d<\/b><\/h2>\n<p class=\"p3\">This is factually incorrect.<\/p>\n<p class=\"p3\">Key points:<\/p>\n<ul>\n<li>\n<p class=\"p1\">Access is guaranteed by the 1972 Free Trade Agreement, which is still in force,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">Switzerland exports more to the EU than it imports,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">80 % of exports need no dynamic recovery.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">And for finance - Denis Pittet's area of expertise:<\/p>\n<p class=\"p3\">The financial sector is not even <span class=\"s3\"><b>not<\/b><\/span> included in Unilateral Agreements III.<\/p>\n<p class=\"p3\">The idea of massive relocations is a political fantasy, not an economic reality.<\/p>\n<h2><b>7. \u201cRegulatory proportionality must be maintained\u201d.\u201d<\/b><\/h2>\n<p class=\"p3\">But this is precisely what the EU cannot offer.<\/p>\n<p class=\"p3\">European law is :<\/p>\n<ul>\n<li>\n<p class=\"p1\">massive,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">centralised,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">standardised,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">designed for 450 million people.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">Switzerland is based on :<\/p>\n<ul>\n<li>\n<p class=\"p1\">proportionality,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">a variety of business models,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">direct democracy,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">flexibility.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">Importing European regulation means destroying what makes Geneva, Zurich and Lugano so strong.<\/p>\n<h2><b>8. \u201cSwitzerland must remain competitive with Dubai and Singapore\u201d.\u201d<\/b><\/h2>\n<p class=\"p3\">Exactly.<\/p>\n<p class=\"p3\">But the answer cannot be: no more European law.<\/p>\n<p class=\"p3\">The only coherent strategy is :<\/p>\n<p class=\"p3\">\u2192 financial sovereignty,<\/p>\n<p class=\"p3\">\u2192 neutrality,<\/p>\n<p class=\"p3\">\u2192 autonomous system of penalties,<\/p>\n<p class=\"p3\">\u2192 internal stability.<\/p>\n<p class=\"p3\">As Ludwig von Mises said :<\/p>\n<p class=\"p4\"><b>\u00abA country remains stable only if it masters its own laws.\u00bb<\/b><\/p>\n<h2><b>Conclusion - The Unilateral III Agreements are a historic strategic mistake<\/b><\/h2>\n<p class=\"p3\">Denis Pittet defends a reassuring but mistaken vision: that stability will come from Brussels.<\/p>\n<p class=\"p3\">The reality is the opposite:<\/p>\n<p class=\"p3\">\u2192 Swiss stability is the fruit of our independence, not our alignment.<\/p>\n<p class=\"p3\">The Unilateral III Agreements are neither bilateral nor strategic:<\/p>\n<ul>\n<li>\n<p class=\"p1\">these are subordination agreements,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">gradual regulatory take-up,<\/p>\n<\/li>\n<li>\n<p class=\"p1\">a loss of sovereignty without a popular mandate.<\/p>\n<\/li>\n<\/ul>\n<p class=\"p3\">Switzerland has never grown by aligning itself.<\/p>\n<p class=\"p3\">It has prospered by asserting itself.<\/p>\n<p class=\"p3\">It's time to say it again.<\/p>","protected":false},"excerpt":{"rendered":"<p>At some point we have to stop using euphemisms: what some people still call \u201cBilaterals III\u201d is in reality a set of Unilateral III Agreements, in other words the automatic adoption of European law, without a seat, without a vote and without a veto.
